NHP MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND YOU AGREE THAT ALL SUCH OTHER REPRESENTATIONS AND WARRANTIES ARE HEREBY EXCLUDED AND DISCLAIMED. NHP'S TOTAL LIABILITY BASED ON THIS AGREEMENT IS LIMITED TO THE AMOUNT PAID BY YOU DURING THE FIRST MONTH IMMEDIATELY PRECEDING THE DATE ON WHICH AN ALLEGED BREACH OR DEFECT WAS DISCOVERED OR SHOULD HAVE BEEN DISCOVERED. NHP shall, in addition to any other remedies that it may have, deactivate your subscription to the Product without notice upon (1) non-payment of amounts due, (2) any violation of the Terms of Use Policy, or (3) any use of the Product that NHP, in its sole and absolute discretion, deems improper.
